Terms of Service

SiteWise SWMS is a software tool for creating, signing, sending, exporting and storing SWMS records. It is not legal advice, safety consulting, engineering advice or a substitute for competent workplace health and safety review.
Customer Responsibility For SWMS
The customer, and not Zenora Digital Pty Ltd, is responsible for each SWMS created, edited, issued, signed, sent, exported or used through SiteWise SWMS.
Before a SWMS is issued, signed or used onsite, the customer must review and decide whether it is accurate, complete, site-specific and suitable for the work being performed. The customer remains responsible for determining whether a SWMS is required, identifying hazards and controls, checking site conditions, consulting with relevant people, implementing controls, reviewing changed conditions and keeping required records.
No Compliance Guarantee
SiteWise SWMS helps structure records around common Australian SWMS requirements, but we do not guarantee that any SWMS, template, suggestion, PDF, signature record or evidence pack will satisfy WHS laws, regulator expectations, principal contractor requirements, insurer requirements or customer requirements.
The customer should obtain professional WHS, legal, engineering or other advice where needed. The customer must not rely on SiteWise SWMS as the only safety review for high-risk construction work.
Templates And Generated Suggestions
Templates, examples and generated wording are starting points only. They may be incomplete, unsuitable, outdated or wrong for a particular site, job, worker, plant item, jurisdiction or principal contractor.
Generated content must be reviewed and edited by the customer before use. SiteWise SWMS does not provide automatic compliance decisions, safety guarantees or regulator-approved content.
Worker Sign-Off
Worker sign-off records that a user has reviewed and confirmed the SWMS inside the software. It does not prove that the SWMS is legally adequate, that controls were implemented onsite, or that work was carried out safely.
Workers should not sign a SWMS if they do not understand it, if it does not match the work, or if conditions onsite are different from the document. The customer remains responsible for supervision, training, consultation and implementation.
Records, Exports And Retention
SiteWise SWMS stores documents and evidence according to the customer account, plan and applicable product settings. SWMS credit records are intended to be retained for at least 12 months unless a longer retention setting or agreement applies.
The customer is responsible for exporting, backing up and retaining any records required for legal, regulator, incident, insurance, principal contractor or business purposes.
Payments And Subscriptions
Pricing is shown in AUD. SWMS credits are redeemed when a SWMS record is built and issued. Unlimited is a monthly subscription. Stripe handles checkout, receipts, payment methods and subscription management.
Acceptable Use
The customer must not use SiteWise SWMS to upload unlawful content, misrepresent safety records, bypass payment controls, interfere with the service, access another business account, or use the service for work where they are not competent to assess safety requirements.
Service Availability
SiteWise SWMS may be unavailable because of maintenance, third-party providers, network issues or incidents. It is not an emergency safety system. The customer must maintain practical fallback processes for critical site safety documentation.
Liability
Nothing in these terms excludes rights or guarantees that cannot be excluded under Australian law. To the maximum extent permitted by law, Zenora Digital Pty Ltd is not responsible for loss arising from customer-created SWMS content, site-specific safety decisions, failure to review or implement controls, worker conduct, principal contractor decisions, regulator action, or misuse of the service.
To the maximum extent permitted by law, our liability for the service is limited to resupplying the service or refunding the fees paid for the affected service period or affected SWMS credit transaction.
